Is it stealing if I just use them for “personal use?” Sometimes I use more than one of them at a time.
Originally we linked all the thumbnails to your pics, but we were getting complaints that all the links were dead because your server could not handle the traffic. We tried. Some of the thumbnails do still link to you. Also, just because you watermark a photo, does not mean you own the copyright. We acted in good faith, maybe you should do the same.
The good thing is.
They are looking up to you.

My exclusives get stolen all the time. I’ve even had one company steal my images that I myself took at a press conference and try to tell me that I was mistaken. Another company stole a watermarked image and printed it. Go figure.
One trick I’ve started doing to track who’s taking what is to everso slightly change a manufacturer supplied image and see where it ends up. Just enough so that I can spot, but they can’t.
All in all, it’s a fruitless soul destroying task.

If you are going to bash our site, at least have the decency to post our rebuttal. As I said before (comment not approved), COED originally linked directly to the images on this site, but the macenstein server was constantly giving error messages due to the amount of traffic we were sending. We are always good about sending traffic and giving credit where credit was due.
If you use one to tease and link it’s an ad for you, otherwise it’s just stealing. That sucks.

Glad you like the pics, and we’re really just busting your balls. However, it wasn’t that we can’t handle the traffic, we just disabled hotlinking in general for all posts.
And those pics are ours, taken specifically for our Mac chick feature, so we’re totally allowed to watermark them.

MacEnstein doesn’t need to file with the copyright office to protect their work as there is a basic understanding in law both in the USA and in Canada of what rights an Artist has to protect their work. This is one of the reasons why Apple got into trouble when they used images taken by an Artist to advertise their Apple TV without getting permission from the Artist or even paying him any royality fee for using the images. Since the photographs were done by MacEnstein for posting on this site, not someone else’s it doesn’t give anyone the right to copy the images to help boost their site web traffic or reader publication for their magazine.

yeah, the editor at coedmag is just dead wrong in what he is implying – copyright has NOTHING to do with whether or not you put a watermark or copyright message on the image.
as Paul and Imagine Engine both say above, in US and Canada, if the photo is yours, then it’s yours. period. regardless or marking, notice, or otherwise.
using such photos without approval of the owner is a copyright violation. just because they are on the web does not mean they’re free for all.
p.s. “acting in good faith” would be more like sending an email to macenstein asking permission to repost the photos. or putting a clear notice stating the source of the photos.
stealing them is just not cool. aside from clearly in violation of copyright.

Embedded deep linking to dense content (video, images, etc) is just plain rude. It’s considered leaching of bandwidth.
Copying your images to your server, while the better option, without attributes, is also, just plain rude.
You had two options here. Either link to the “Mac Chick of the Month” page, or get permission to use the pics with attribution. Not hard.
I’m shocked that this late in the game, people, even those from money making sites, still think its ok to “borrow” the content of other’s work.
Don’t be an ass in the future. Ask.
